Legalizing the trap: 'no' is the only option

In the midst of the electoral context, a certain sector of the Congress of the Republic seems to have found the opportune moment to reactivate initiatives that do not usually prosper during the five-year term, due to the spotlight effect on their irregularities

Amid its enormous disrepute, it is once again putting on the agenda projects that openly strain legality and compromise the sustainability of a strategic sector.

These are initiatives presented by parliamentarians José Pazo and Jorge Marticorena, aimed at “formalizing” vessels built illegally in clandestine shipyards. They do not seek to correct flaws in the system, but rather to legitimize what was conceived in violation of the law.

Let us recall that, in 2018, through Legislative Decree 1392, the Ministry of Production (PRODUCE) implemented the System for the Formalization of Artisanal Fishing (SIFORPA II), known as the “Fishing REINFO.” This was established as an extraordinary, exceptional, and strictly temporary regime, in force from October 2018 to July 2023. The process defined precise stages: registration, verification of existence by the General Directorate of Captaincies and Coast Guard (DICAPI), obtaining registration, and access to the fishing permit.

During its validity, it allowed the formalization of more than 2,400 artisanal vessels. Nearly 2,000 applications were excluded for failing to demonstrate the actual existence of the vessels at the time of registration, revealing attempts to force a benefit without basis. As in any exceptional regime, there were those who complied with the rules and legitimately accessed the system, and those who sought to take advantage of it without meeting the minimum requirements. It is precisely this latter group that is now being targeted for benefit through legislative means.

This has already been attempted before: similar initiatives, promoted by the same congressman Pazo in 2023 and 2025, were shelved after receiving unfavorable technical opinions. PRODUCE was categorical: the Fishing REINFO fulfilled its purpose and its reopening would be unlawful. Moreover, fisheries such as pota (jumbo squid) and perico (mahi-mahi) are already fully exploited and do not admit new participants. For its part, the DICAPI warned that the lack of timely verification raises serious doubts about the real existence of many vessels, or about their construction without authorization. Genuine artisanal guilds are also staunch opponents of these suspicious and irregular proposals.

In this context, attempting to reopen a regime that expired long ago not only disrupts the system, but also sends messages of instability and discouragement: deadlines do not matter, laws are negotiable, and science has no place in the debate. The rule that is irresponsibly being pushed would put at risk a key fishery that generates more than one hundred thousand jobs and 1.4 billion dollars annually in exports. Reactivating the Fishing REINFO would, in practice, reward illegality, unpunctuality, and collusion. It would also set a terrible precedent.

The Congress cannot feign ignorance in the face of the growing public conviction that certain legislative decisions end up favoring circuits where organized interests operate outside the law. Persisting along this path will reinforce that perception to the utmost. No parliamentarian — even less those who are part of the board of directors — will later be able to claim distraction due to the electoral campaign. There is no room for ambiguity here: voting in favor will be, for citizens, an unequivocal stance.

As Montesquieu warned: “There is no tyranny more cruel than that which is exercised under the shadow of the laws and with the appearance of justice.” Legalizing the illegal, in cases like this, does not make it legitimate: it worsens it. The project in question does not withstand technical or legal analysis. Its only reasonable — and politically responsible — outcome is definitive shelving.

**議会(Congress)は、特定の立法判断が法の外で活動する組織的利益を助長しているという市民の高まる確信に対して、無知を装うことはできない。この路線を続けることは、その認識を極限まで強めることになる。いかなる議員も――とりわけ理事会(board of directors)**の一員である者はなおさら――選挙運動を理由に後から注意不足を主張することはできない。ここに曖昧さの余地はない。賛成票を投じることは、市民にとって明確な立場表明となる。
