Cepa and the naval industry request more time to participate in the entry of squid 'jiggers'

These business entities and a naval union requested the Federal Fisheries Council to extend the deadline for submitting projects for the squid fishery, which expired on June 19, in order to promote national construction.

The notes recently presented to the Federal Fisheries Council regarding the entry of new jiggers did not reflect a generalized rejection, but rather a formal request to extend the deadline for participating in the tender. The Centro de Patrones was the only entity that requested this week the suspension of Resolution 6, which authorized the entry of 18 new squid jigging vessels. On the other hand, the majority of the submissions from the naval industry, such as the Federación de la Industria Naval Argentina (FINA), the Consejo de Ingeniería Naval (CIN), the Sindicato Argentino de Obreros Navales y Servicios de la Industria Naval de la República Argentina (SAONSINRA), and the Asociación de Astilleros y Talleres Navales Argentinos (ABIN), petitioned for an "extension or amplification of the deadline to present projects." The Consejo de Empresas Pesqueras Argentinas (CEPA) made a similar presentation, focusing on "the principle of competition", and added the request to equalize the scores awarded to landing ports when evaluating each proposal. Meanwhile, the Province of Buenos Aires maintained its objections and is considering legal action, according to reports from Revista Puerto.

After analyzing the notes received, the members of the Federal Fisheries Council decided by majority to forward them to the enforcement authority, arguing that the deadlines had already been established by Resolution 8 (which modified Resolution 6) for a period of 15 business days starting from June 1. This regulation stipulates: “Submissions must be made within a period of 15 business days from the publication of this resolution in the Official Gazette, which may be extended by the Procedural Authority. Any submission made after the expiration of the established deadlines will be rejected without further processing.”
Although the councilors did not flatly reject the requests, the Representative of the Province of Buenos Aires cast a negative vote and, anticipating the response of the authority, stated: “it is evident that if the request for an extension made by the group of fishing chambers and national shipyards is not granted, any possibility of having Argentine-built vessels will be practically impossible,” adding that “the powers granted to the enforcement authority are improper, and the resolution corresponds to this body.”

The stance of the Buenos Aires representative is supported by an objective fact: at least four of the notes were submitted after the deadline. The 15 business days granted for the presentation of projects expired on June 19, under the validity of Resolution 6/26, while two of the presentations were made on June 25, another on June 29, and the last one on June 30.
Although the minutes reflect that the requests seek an extension of deadlines for "nationally built" projects, the registration deadlines fixed in both resolutions 6 and 8 do not differentiate between nationally built or imported vessels. This distinction is applied solely at the moment of registering the units into the shipping register.

The resolutions that authorized the entry of the 18 jiggers established that approved projects will have until December 31, 2027, to be registered if they are used imported vessels; until December 31, 2028, for new vessels built abroad; and until December 31, 2029, for those of national construction.
Regardless of the submission date, the conceptual basis of the requests could challenge the procedure, a scenario that the provincial representative anticipates in her statement.
In the business sector, CEPA formally requested to modify the current scheme to extend the project submission period to no less than 180 calendar days from the publication of Resolution 8/26 in the Official Gazette, which occurred on 11 de junio.

From CEPA, they argued that the current 15-day period is insufficient and violates the principle of competition, pointing out that this limitation “determines that not all, but only some companies that had prior knowledge of the implemented measure will be in a position to make the submission, while the rest will not.” Likewise, they maintained that a more extended deadline “will contribute to strengthening the call, favoring a greater participation of projects.” The document to which REVISTA PUERTO had access also details the chamber's request to equalize the allocation percentage received by each operating port.
Buenos Aires would go to court
Unlike the position adopted by CEPA, the Province of Buenos Aires openly declared itself against the entry of the jigging vessels through a motion for reconsideration signed by the Minister of Agrarian Development, Javier Rodríguez. The provincial presentation has two main pillars: the requirement of solid scientific information to back the resolution, beyond the technical note presented by the Director of Research of INIDEP, and the questioning of the differentiated scoring system for ports, which grants the lowest score to those in Buenos Aires, categorized by the province as unconstitutional.

Although the Buenos Aires administration requested prompt treatment for its motion, the provincial alternate representative, Carlos Liberman, confirmed that if a favorable response is not obtained, there is a determination to resort to judicial instances.
Now that the submission deadline has passed, the list of selected projects is expected to be released in the coming days, starting the formal timeframe for their registration. In the current scenario, the filing of an injunction represents the only way to interrupt this process. The Federal Fisheries Council will meet again in 15 days, at which time the final outcome of this measure approved by majority will be known.
