Export Conditions for Fishery and Aquaculture Products to the United States to Remain Until December 31, 2025
(CHILE, 1/26/2024)
From the United States it was reported that it will take two more years to review the information sent by our country and the rest of the nations exporting fishery and aquaculture products - from November 2021 - in accordance with the entry requirements to that market established by the Law. of Marine Mammal Protection (MMPact).
After the announcement, the Undersecretary of Fisheries and Aquaculture, Julio Salas, gave a sign of calm to the fishing and aquaculture sector, informing that during these two years they will be able to continue with export activities of their products to the United States, as stated. they do today.
"The conditions for exports of fishing and aquaculture products to the United States will be maintained until December 31, 2025," the authority said. However, he pointed out that "these new market demands alert us to the growing importance of monitoring and reducing the potential impacts of fishing. In addition, they motivate us to continue working, together with the sector, for the sustainability of the activity."
In that sense, Salas explained that Chile has provided the information requested by the United States in all phases of the process since 2016 and valued the collaboration of the fishing and aquaculture sector. "We have made significant progress in monitoring, regulatory design and incorporation of plans and protocols to reduce the incidental capture of marine mammals. In November 2021, in accordance with the established deadline, we sent the information required to obtain this certification for each fishery, and we are waiting for the response from the United States," he said.
And he assured that the Undersecretariat continues to work uninterruptedly on this matter, in harmony with our current regulations and with the objective of promoting sustainable and sustainable fishing.

Background
In 2016, the United States modified its Marine Mammal Protection Act (MMPAct), so that foreign fisheries that export to that country have similar standards to those of the North American fleets in terms of sustainability regarding the impact on marine mammals.
The import provisions also establish the criteria for evaluating the regulatory program submitted by an exporting country to reduce the bycatch of marine mammals and the procedures for receiving authorization to export fishery and aquaculture products to the United States.

To ensure, at the international level, effective implementation of the challenges imposed by the MMPAct, the import provisions established a five-year exemption period, in order to allow exporting countries time to develop, as appropriate, regulatory programs with standards comparable to US programs. The above involved the delivery of different reports and background information by Chile.
Thus, on November 16, 2023, the Department of Commerce and the National Marine Fisheries Service (NMFS) of the United States issued a notice again extending the exemption period for two additional years, until December 31, 2025, for that the fisheries and aquaculture of exporting nations receive their "comparability findings" (or application result) to continue exporting to that country. In the meantime, there are no restrictions on exports, but the actions that supported the application must be maintained.

This is because according to the NOAA -National Oceanic and Atmospheric Administration- after careful consideration, the Department of Commerce and the NMFS came to the conclusion that additional time is required to effectively complete the evaluation process of the records submitted in November 2021.
This decision is influenced by the considerable number of foreign fisheries, the changing nature of fisheries data, and the practical challenges associated with evaluating the comparability of regulatory programs in foreign countries.
